Vioxx® is a non-steroidal anti-inflammatory drug prescribed for arthritis and menstrual cramps. It is made by the pharmaceutical giant Merck & Co., the second-largest drug manufacturer/distributor in the United States. Vioxx® was approved by the Food and Drug Administration (FDA) in 1999, and was withdrawn from the market in September 2004 after it was linked to increases in the occurrence of heart attack and stroke among its users. Vioxx® Verdicts

August 2005: A Texas jury found Merck guilty in a wrongful death lawsuit brought by a widow whose 59-year-old husband died in May 2001 from heart failure after taking Vioxx® for his arthritis. The jury awarded Carol Ernst $253 million in damages, which included $229 million in punitive damages. Her husband Robert, a Wal-Mart produce manager and a triathlete, had taken Vioxx® for eight months.

April 2006: A New Jersey jury found Merck guilty of not properly warning users of the risks associated with the use of Vioxx®, and of misrepresenting the risks to physicians. The jury awarded John McDarby, 77, and his wife Irma a total of $4.5 million in compensatory damages. McDarby suffered a heart attack in 2004 after taking Vioxx® for four years. The jury also held Merck responsible for $9 million in punitive damages.

April 2006: A jury in Rio Grande City, Texas found Merck liable for the fatal heart attack of Leonel Garza, 71, who had taken Vioxx® for less than one month. The damages awarded include $7 million in compensatory damages to the family of Garza, and $25 million in punitive damages against Merck.
